Like the other NSFW sites that are covered in this project, Pornhub has extensive Terms of Service, a Privacy Policy, and a Copyright Policy. All of these together encompass the full agreement between the site and users. There are separate provisions for registered users and site visitors, both of whom may have some information collected about them when they visit the site. The copyright policy meets the DMCA requirements for operation in the USA and the sharing agreement is rather limited. Unless customers explicitly opt-in to a program or there is a duty imposed on the site to disclose, then no third-party would get direct access to your data. However, under the agreement, third-party advertisers would get access to place and track cookies on your browser, which may explain the curious ads that have been following me around since I last visited the site to check the terms!
